Article 3 – Applicability
- These terms and conditions apply to every offer from Zallie and to every agreement concluded via the webshop.
- Before an order is completed, these terms and conditions are made available digitally so that the customer can read and save them.
- By placing an order, the customer confirms having been able to read these terms.
- If any provision of these terms proves invalid or unenforceable, the remaining provisions remain in force. The statutory rights of consumers always continue to apply.
Article 4 – Offer and formation of the agreement
- Zallie offers artworks and decorative products, including posters and canvases, which, depending on the product, can be customised using the Zallie Studio.
- Zallie strives to display products, materials, dimensions and colours as accurately as possible on the website.
- Because screens, colour settings, printing techniques and materials differ, the final printed colours may deviate slightly from the digital display. This also applies to artworks composed with colour palettes inspired by the work of Sanzo Wada.
- Small, customary differences between a digital colour display and the printed product do not automatically constitute a defect. The product must, however, conform to the agreement and to what the customer may reasonably expect.
- The customer is responsible for carefully checking any text they entered, chosen colours, sizes and other personal settings before completing the order.
- The agreement is concluded when the customer completes the ordering process and the order is confirmed by Zallie.
- After placing an order, the customer receives a confirmation by email with the relevant order details and information about the agreement.
Article 5 – Prices and payment
- All prices on the website are in euros and include applicable VAT, unless expressly stated otherwise.
- Any shipping costs and other additional costs are clearly shown before the customer places the order.
- Payments are processed securely via payment partner Stripe.
- The available payment methods, including iDEAL, credit card and Apple Pay where offered, are shown at checkout.
- Zallie processes orders once payment has been successfully completed, unless expressly agreed otherwise.
- Zallie reserves the right to change prices and offers. Price changes do not affect orders already confirmed, except where the law provides otherwise.
Article 6 – Production and delivery
- Zallie works with specialised print-on-demand partners to produce and ship artworks.
- After successful payment, orders are forwarded digitally for processing and production.
- The expected delivery time is usually 3 to 7 working days after the order is placed, unless stated otherwise with the product or at checkout.
- The stated delivery time is an indication. If an order is delayed, Zallie aims to inform the customer as soon as possible.
- The consumer's statutory rights in the event of late or failed delivery remain fully applicable.
- Delivery takes place at the address provided by the customer during the ordering process. The customer must check these details carefully.
- Zallie remains responsible for correct delivery, even when production and shipping are carried out by an external partner.
- For consumers, the risk of damage or loss passes at the moment the order is physically received by the consumer, or by a third party designated by the consumer who is not the carrier, unless the law provides otherwise.
Article 7 – Right of withdrawal and returns
7.1 Personalised and custom-made products
- Zallie offers products that can be composed or customised via the Zallie Studio.
- For products that are actually manufactured to the customer's individual specifications or clearly intended for a specific person, the statutory right of withdrawal may be excluded under Article 6:230p of the Dutch Civil Code.
- Where this exception applies, the customer is clearly informed before placing the order.
- For such custom-made products, there is no statutory right to withdraw from the order within 14 days without giving a reason.
- The mere fact that a product is printed only after ordering, or that the customer chooses from standard colours, standard designs or standard sizes, does not automatically mean the statutory right of withdrawal lapses.
7.2 Products to which the right of withdrawal applies
- Where a product does not fall under a statutory exception, the consumer has the right to withdraw from the agreement within 14 days of receiving the product without giving any reason.
- The consumer can exercise the right of withdrawal by sending an unambiguous statement to zallie@zallie.com within the cooling-off period.
- After withdrawal, the consumer has 14 days to return the product.
- The direct costs of returning the product are borne by the consumer. Zallie states this at checkout before the purchase.
- Zallie refunds payments received for the withdrawn product, including standard delivery costs where legally required, no later than 14 days after receiving the notice of withdrawal.
- Zallie may withhold the refund until the product has been received or until the consumer has shown that the product has been returned, whichever is earlier.
- Refunds are made using the same payment method as the original payment, unless agreed otherwise.
- The consumer is only liable for any reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.
7.3 Cancelling orders
- A request to change or cancel an order can be submitted as soon as possible via zallie@zallie.com.
- For products lawfully excluded from the right of withdrawal, Zallie is not obliged to accept a cancellation once a binding agreement has been concluded. Zallie may, as a courtesy, consider whether cancellation or changes are still possible.
- For products to which the statutory right of withdrawal applies, the consumer's rights remain fully intact.
Article 8 – Statutory warranty and product quality
- The statutory warranty applies to all Zallie products.
- This means a product must conform to the agreement and to what the consumer may reasonably expect of it.
- If a product arrives damaged, was produced incorrectly or has another defect, the customer can contact zallie@zallie.com.
- Zallie may ask for a clear description and, where possible, photos of the problem in order to assess the complaint quickly and carefully.
- In the case of a defect for which Zallie is responsible, the consumer is entitled to a free remedy in accordance with the statutory warranty rules, such as repair or replacement. If this is not possible or does not happen within the statutory conditions, other statutory rights may apply, including a price reduction or termination of the agreement.
- The statutory warranty also applies to personalised and custom-made products.
- Any additional service or goodwill from Zallie does not affect the consumer's statutory rights.
Article 9 – Intellectual property
- All intellectual property rights in designs, graphic elements, images, texts, digital applications and other creative works developed by Zallie belong to Zallie or the relevant rights holders.
- The purchase of a physical artwork does not transfer any copyright or other intellectual property rights.
- Without the prior written consent of the rights holder, it is not permitted to copy, digitise, reproduce or commercially exploit protected Zallie designs, unless permitted by law.
- The customer may use, display and resell the purchased physical artwork to the extent permitted by law.
- When the customer supplies their own text, images or other material, the customer declares that its use does not infringe the rights of third parties. This provision does not limit Zallie's statutory responsibilities.
Article 10 – Complaints and customer service
- Zallie strives for satisfied customers and careful handling of questions and complaints.
- Complaints can be submitted via zallie@zallie.com, stating the order number and a description of the complaint.
- Zallie asks customers to report complaints as soon as possible after discovery. For consumers, a report within two months of discovering a defect is in any case considered timely.
- Zallie aims to respond substantively to complaints within 14 days of receipt. If more time is needed, the customer will receive a message within this period with an indication of further handling.
- If a complaint cannot be resolved by mutual agreement, the consumer retains the option of using the legally available dispute procedures or the competent court.
Article 11 – Personal data and privacy
- Zallie processes personal data for purposes including processing and delivering orders, customer service and other purposes described in the privacy statement.
- When processing personal data, Zallie complies with applicable privacy legislation, including the General Data Protection Regulation (GDPR).
- More information about the processing of personal data can be found in the privacy statement at www.zallie.com.
Article 12 – Applicable law and disputes
- Dutch law applies to agreements between Zallie and the customer.
- If the consumer lives outside the Netherlands, any mandatory consumer protection rules of the country of the consumer's habitual residence continue to apply, insofar as the law requires.
- The parties will preferably first try to resolve disputes by mutual agreement.
- If this fails, the dispute may be submitted to the court competent under the applicable statutory rules.
